Signature of Robert Hardman Vice President of MERS

Here is a document that shows a signature of Mr. Robert Hardman, who is a Vice President of MERS (although it is not clear there was a board of director meeting approving him for such role). We also do not believe her earns a salary from MERS. At any rate, this is a publicly recorded document that purports to have MERS (who the Deed of Trust says is the “nominee” for the “lender and their successors and assigns” purporting to substitute the trustee “as nominee of american home mortgage servicing, Inc.

We contend that this is NOT a valid substitution of trustee as the loan servicer (AHMSI) has no authority to sub out the trustee. The lender/beneficiary is the sole entity with the power to do that under the Deed of Trust. If the substitution of trustee is not valid, the foreclosure sale should be set aside. We will be arguing this in an upcoming case.

Obviously, the foreclosure documents and chain of title documents must be closely examined in every foreclosure case involving a securitized loans. The lenders, servicers, and even the trustee’s think they can do whatever they want. We disagree and believe the foreclosure laws must be strictly followed and any invalid sale must be set aside without any obligation to tender the balance of the loan.

This is but one of our legal arguments. In many cases, the judge will decide the fate of the case.

Does anybody have any signatures purporting to be those of Scott Walter (alleged Vice President) on loan documents

I need some signatures to compare. Please email me at steve@vondranlaw.com. I will be posting all the signatures I collect on this website in the near future. The document I am trying to figure out is a Substitution of Trustee. Mr. Walter is not being implicated at this time, until and unless signatures show differently. We sent a notary demand letter to the notary who supposedly witnessed his signature. The notary failed to produce the transaction logs. HELP! Need this for a pleading.

What the heck? Now the notaries are claiming they lost their logs. Notary fraud is running rampant. They are aiding and abetting the so-called “lenders” in committing foreclosure fraud

Don’t stand for this people. It is time to start filing police reports and complaint with attorney generals. The banks have bought off the notaries who gave up their notary stamps for profits. We are conducting securitization audits, and chain of title audits, and we are finding fraudulent signatures and false notaries. We will shortly be exposing a GIGANTIC scam coming from the biggest foreclosure defense law firm in Arizona. We will be posting clear cut proof of notary fraud.

What we are finding is a bunch of false signatures, false statements in regard to who the “beneficiary” of your loan is, and other nonsense in the chain of title (assignments of deed of trust, substitution of trustee, notice of default, notice of sale and false affidavits. The problem has reached epidemic proportion. Foreclosures are taking place without any real proof of loan ownership. As Neil Garfield teaches, the financial house of cards is a “living lie.” TAKE NO MORE. Start filing your complaints. Here is a California complaint form dealing with notary fraud.
